Job Title : Property and Leasing Manager

The Property and Leasing Manager will be responsible to fulfil the role of National and African Leasing Manager for the Group administration relating to the end to end aspect of leasing properties

Key Performance Areas
Retail Leases
Consult and negotiate with Landlords regarding certain commercial terms and trading issues including retail leases offers to lease rental and other lease reviews as well as general terms and conditions contained in hybrid Leases
Receive and respond to all correspondence from Counsel Tenants Landlords Potential Tenants
Full leasing administration focusing mostly on new developments and renewals
Liaise with company legal departments and Landlords/Developers to ensure that all new leases and renewals are timeously negotiated and professionally assembled signed and accurately reflect the agreement reached between the parties
Ensure that all lease documentation are completed and up to date at all times
Ensure that all options to renew are exercised timeously and advising the Property & Development Executive of such upcoming renewals
Draft annual Lease Renewal Schedules containing all lease renewal rental and other imposts details for both Finance and EXCO purposes
Draft and compile Lease Agreements Cancellation Agreements Amendment Agreements Addenda to Leases Sale Agreements Marketing and Events Agreements Service Level Agreements Cession & Assignment Agreements and related documents for major malls shopping centers property development companies and regional offices country wide
Correspond and meet with Landlords and developers as necessary to maintain efficient and up to date lease documentation and resolving outstanding issues
Credit checks on potential Tenants
Building of lasting relationships with Landlords in terms of facilitation in addressing any of their concerns and vice versa
Suggest and drive potential cost saving ideas in rental and utility costs and overall lease structures
Administer Tenant Installation contributions payable by Landlords and ensuring that same is invoiced and received
Negotiate and control of Tenant Installation contributions payable by Tenant to SubTenants and ensuring that same is properly used for fitout purposes invoiced and paid
Resolve issue and/or deadlocks which may have legal ramifications obtain necessary outside legal advice and documentation as required in conjunction with Legal Department
Draft relevant resolution and securing execution thereof

Property Management
Serve as a single point of entry for tenants with respect to Administration of other owned/rented properties in terms of redevelopment sub letting and any other property related incidents such as rein

Financial
Perusal of invoices for rent receivable including ad hoc reconciling of such invoices
Assist Finance Department in identifying discrepancies in invoices in relation to Agreement/s of Lease and carrying out the necessary reconciliations and following through with Landlords in the event of credits due
As hoc monthly checking on rental payments made to secure conformation with Agreement/s of Lease
Analyse variations determining possible causes writing to and advising the relevant Landlords and where appropriate conducting due diligence exercises requesting reduction re evaluation or appropriate action
Ensure that the agreed or appropriate reductions/credits are implemented passed and reflected on the following months statement
Calculation and analysis of turnover figures where turnover rental payable for renewal purposes
Manage Tenant Investment Accounts

Legal
Draft legal letters of demand agreements and other related contracts
Draft of legal opinions and advice on leasing related issues
Handle legal related matters in Property & Development be that conveyancing matters sale of business and/or property matters
Negotiating of Agreement/s of Leases with Landlords attorneys as and when the need arises

Other
Assist in forwarding/facilitating ad hoc enquiries when the opportunity arises relating to new possible sites for outlets to be erected within new shopping centres country wide alternatively existing sites where company can take over sites from competition
Preparation of renewal schedules for board packs
Full portfolio management of Franchised/Management theatre legal agreements nationally and internationally
Slight involvement in projects such as resolving air conditioner disputes and negotiating amendments to standard specification
Improve technical skills and knowledge relating to theatres in order to link with relevant legal procedures
Become more familiar with company sites by visiting either as customer or as representative

Requirements
Minimum of 3 years experience in Retail leasing
Matric
Legal or Leasing related/ relevant Degree/Diploma
Detailed understanding of contracts leasing servicing and legal requirements
Understanding of Company default enforcement clauses
Experience in retail leasing
Good understanding of customer service
Ability to plan schedule prioritise focus and keep others informed

Salary Market related based on qualifications and experience
